Investment firm settles its case against insurer

OKLAHOMA CITY – A Lawton investment company settled a civil lawsuit against its insurer for an undisclosed amount, federal court records show.

Lawton Investments LLC, also known as Executive Inn Hotels, filed a civil action against Berkshire Hathaway Homestate Insurance Company in the District Court of Comanche County in Lawton on March 26. The lawsuit was later moved to United States Federal Court in the Western District of Oklahoma. The Petition cited a breach of contract and bad faith claim against Berkshire for failing to pay an insurance claim, the petition states.

In April 2016, a Lawton Investments building sustained damage due to a hail and windstorm. Almost a year later, the Lawton business filed a claim which was denied, the lawsuit states. As part of the claim investigation, Berkshire Hathaway refused to turn over to Lawton Investments the engineering report the claim denial was based on, the petition states. Lawton Investments claimed an estimate provided by an Oklahoma insurance adjuster valued the loss around $794,548. The notice of a settlement was filed in federal court on Jan. 29, records show.
