Duncan couple accused of child neglect indicted on federal felony gun charges

OKLAHOMA CITY – A Duncan couple charged in Stephens County earlier this year with child neglect and possession of illegal drugs were indicted in Oklahoma City’s federal district court this month on felony firearms possession charges. And one of the defendants pleaded guilty in Grady County District Court last year to two misdemeanor criminal charges.

Quianna Lorraine Varner, 24, is named in three charges of making a false statement during acquisition of a firearm; Devin Michael Brisco, 20, is accused of being a drug user in possession of a firearm; and both are named in one count of being unlawful users of a controlled substance while in possession of a firearm.

Both were being held Monday in the Stephens County Jail at Duncan in lieu of $200,000 bond each. Varner is accused of knowingly making “false and fictitious” written statements:

• in the acquisition of a Taurus 9mm pistol from Smith Pawn & Antique, of Duncan, on Nov. 19, 2019;

• in the purchase of a Century Arms International 7.62 X 39 caliber pistol from Murf’s Guns, also of Duncan, on Nov. 27, 2019;

• in the purchase of a Smith & Wesson .40-caliber pistol from Smith Pawn & Antique on Dec. 26, 2019.

In each instance, federal investigators allege, Varner “falsely represented that she was not an unlawful user of, or addicted to,” any controlled substance, “when in fact she is an unlawful user and abuser of the controlled substance marijuana.”

Brisco is accused of being a drug abuser in possession of a Kahr .45-caliber pistol on Jan. 29, 2020. Both defendants are charged jointly with being users of illegal drugs while in possession of the Century Arms pistol on Jan. 29.

The U.S. Attorney for the Western District of Oklahoma also filed a motion for forfeiture of the Kahr and the Century Arms pistols. Disposition of the other two weapons is unknown.

On Jan. 30 this year, Varner and Brisco both were named in child neglect charges filed in Stephens County, and Brisco also was charged with unlawful possession of a controlled drug with intent to distribute. Jury trials for both are scheduled in Duncan on Sept. 21.

Brisco pleaded guilty in Grady County District Court last November to possession of marijuana and a charge of obstructing an officer in the performance of his duty, a misdemeanor count reduced from a felony charge of driving under the influence with great bodily injury. A third charge, child endangerment by DUI, was dismissed.

Brisco was assessed $990 in fines, fees and courts costs, and was placed on probation for 18 months, state court records show. He also signed a pledge on Nov. 21, 2019, that he would not violate any city, state or federal law during his probationary period.
