Former casino executive sentenced for tax evasion

OKLAHOMA CITY – The former chief executive officer of Lucky Star Casinos in Oklahoma was sentenced Tuesday to a year and a day in federal prison for tax evasion.

Brian Lee Foster, 51, of Norman, pleaded guilty in October 2019 to willfully failing to file federal tax returns for 2012 and 2013.

Foster was the CEO and Director of Gaming for four Lucky Star Casinos until early 2014. According to court filings he earned more than $2.4 million in gross income in 2012-13 but did not timely file federal tax returns for those two years.

U.S. Magistrate Judge Suzanne Mitchell sentenced Foster to 12 months and one day in prison, followed by a year of supervised release. She also ordered him to pay $1,047,241 in restitution to the Internal Revenue Service for taxes owned for 2012 through 2018. Foster must self-surrender to federal prison on October 26.

Lucky Star Casinos is an enterprise of the Cheyenne and Arapaho tribes. They now have five casinos in the state: at Concho, Clinton, Canton, Hammon, and the newest which opened last month at Watonga.
