OKLAHOMA CITY – An Oklahoma City man is suing Sprouts Farmers Market over an accident that occurred at its 63rd Street and May Avenue location.

James Lowe II filed the suit in Oklahoma County District Court. Lowe’s lawsuit, filed last September, alleges that Lowe tripped on the floor carpet inside the store as he was entering the building. Due to the force of the fall, Lowe’s right hearing aid was dislodged from his ear and lost. Lowe’s lawsuit is claiming negligence and negligence per se.

“No one associated with the defendant (Sprouts) made any effort to help located (the) lost hearing aid,” Lowe’s court brief noted.

Because the hearing aid could not be found, Lowe was forced to purchase a new unit for $6,270. Court documents noted that the fall also caused Lowe to break his femur.

In their response, Sprouts denied the allegations, saying if the store had dangers conditions they were “open and obvious” and that Lowe’s claimed damages were the results of preexisting conditions.

Attorneys for Sprouts also asked that the lawsuit be moved to federal court in Oklahoma City.
