FREDERICK – A Davidson man charged with two counts of assault and battery with a dangerous weapon remains in the Tillman County Jail in lieu of a $500,000 bond.

Prosecutors charged Kim Fillmore, of Davidson, March 30 in connection with the shooting that occurred March 21.

Fillmore appeared at his initial court hearing March 30 and requested a public defender. The defendant’s next court date is April 13. Associate District Judge Brad Benson ordered Fillmore to surrender all weapons from his home and wear a GPS monitor if he was released from jail.

Tillman County deputies approached Fillmore’s house just before he began shooting at them through the closed front door, according to a probable cause affidavit prepared by the Oklahoma State Bureau of Investigation. Tillman County Sheriff Bill Ingram and Undersheriff Michael Ebner returned fire as they attempted to find cover, the affidavit shows.

Fillmore, 63, shot several rounds through the front door. When Ingram identified himself, Fillmore fired more rifle rounds through the door, according to the affidavit prepared by OSBI agent Jonathan Santiago.

Deputies requested backup from the Oklahoma Highway Patrol as the shooting continued. OHP’s tactical team and Frederick police officers also responded. As the law enforcement agencies were taking positions outside the house, Fillmore came out the front door carrying a rifle, the OSBI said in a statement.

Fillmore placed the .30-30 rifle on the ground and was taken into custody, according to the affidavit.

Ingram was injured when flying glass from the front door struck his hand. He was treated for his injuries at a nearby hospital and later released. The sheriff was trying to contact Fillmore in connection with a separate investigation that originated a day earlier.
